Formation and Acceptance
The use of the Earthed website (www.earthed.au) (the "Website") is governed by the following Terms and Conditions, which when accepted constitutes an agreement between the person who wants to use the Website ("you" and "your") and EARTHED.AU PTY LTD ("we", "us" and "our").
Your use of the Website, including creating a free or paid membership account, indicates acceptance of these Terms and Conditions. If you do not agree to these Terms and Conditions you should not use the Website or subscribe to any membership. We reserve the right to amend these Terms and Conditions at any time. Where changes are material, we will endeavour to notify you by email.
The Website enables you to:
(a) browse and read newsletter content; (b) create a free member account and access free content; (c) subscribe as a paid member and receive newsletter issues delivered to your email inbox; and (d) manage your membership and account preferences.
Membership and Subscriptions
We offer two types of membership:
Free membership — Free members may access selected content on the Website at no cost. Free membership does not include delivery of newsletter issues to your email inbox unless otherwise stated.
Paid membership — Paid members subscribe for a recurring fee and receive newsletter issues delivered directly to their nominated email address. Paid memberships are billed in advance on a recurring basis (monthly or annually, as selected at the time of purchase).
You may cancel your paid membership at any time through your account settings. Cancellation will take effect at the end of your current billing period and you will continue to receive access until that date. We do not offer refunds for partially used billing periods unless required by law.
We reserve the right to change membership pricing. Where we do so, we will provide you with reasonable notice before any price change takes effect.
Using the Website
You agree that you are solely responsible for the accuracy and completeness of the information you provide when creating an account or managing your membership.
You agree to grant us a licence to any content or information provided by you via the Website. No royalty or fee is payable by us to you for this right.
You acknowledge that we are not responsible for:
(a) failure to deliver newsletter emails due to incorrect email addresses provided by you; (b) newsletter emails being filtered into spam or junk folders by your email provider; (c) any interruption to email delivery outside of our reasonable control; (d) loss or corruption of any information provided by you; or (e) any errors arising from inaccurate or incomplete information provided by you.
You acknowledge that we own the copyright and all other intellectual property rights in the Website and all content published by Earthed, including newsletter issues.
The information you submit to the Website must not, in any way, be harmful to us or any third party. Without limiting any provision of these Terms and Conditions, any information you submit must not:
(a) be false, inaccurate, misleading or deceptive; (b) infringe any third party's copyright, patent, trademark, trade secret or other intellectual property, privacy or confidentiality rights; (c) violate any applicable law, statute, ordinance or regulation; (d) be defamatory, threatening or harassing; (e) be obscene or contain material that, in our sole discretion, is inappropriate or unlawful; or (f) contain any malicious code, virus, or other harmful instructions that may damage or interfere with the Website or any related systems.
Content and Intellectual Property
All newsletter content published by Earthed, including articles, commentary, images and other materials, is owned by EARTHED.AU PTY LTD and is protected by copyright. You may not reproduce, distribute, adapt or republish any content without our prior written consent.
Your paid or free membership grants you a personal, non-transferable licence to read and access Earthed content for your own private, non-commercial use only.

The Website may contain links to external websites operated by third parties. These external sites are outside our control. We are not responsible for their content or accuracy, and any link does not imply endorsement. Linked sites will have their own terms and conditions of use and you should familiarise yourself with them.
Security and Privacy
We take reasonable steps to protect your personal information and ensure the Website is secure. However, you acknowledge that electronic data transfers are potentially susceptible to interception by others and we cannot guarantee the absolute security of information transmitted to or from the Website.
Your personal information, including your email address and payment details, is handled in accordance with our Privacy Policy, which is available on the Website. By using the Website, you consent to the collection and use of your information as described in that policy.

No Agency
